Copyright over the material which appears on the Liverpool Plains Shire Councils Internet site is subject to the operation of the Copyright Act 1968.

In keeping with Liverpool Plains Shire Council's commitment to encouraging the availability, dissemination and exchange of information (and subject to the operation of the Copyright Act 1968), you are welcome to download the materials which appears on the Liverpool Plains Shire Council Internet site for personal, in-house or non-commercial use, without formal permission or charge.

Duration of Copyright

If a photograph is in copyright, then the copyright owner holds the rights to reproduce and publish the photograph.  Since 01 January 2005:

  • for photographs that were still in copyright on 01 January 2005, or which were created on or after that date, copyright now lasts until 70 years from the end of the year the photographer died. 
  • if the photographer is unknown or used a pseudonym, duration continues indefinitely until the photograph is published.  Once it is published, duration will then last until 70 years from the end of the year in which it was published. 
  • where a Commonwealth, State or Territory Government owns copyright in a photograph, the work is protected by copyright for 50 years from the end of the year in which it was first published. 
  • all photographs taken before 01 January 1955 are not out of copyright.

The images available within the Liverpool Plains Photo Gallery are provided for research and study as permitted under the fair dealing provisions of the Copyright Act 1968.  You may download, display, print and reproduce this material in unaltered form only for your personal non-commercial or personal research use. 

If the original photograph is still in copyright and your proposed use falls outside the fair dealing provisions, you must request clearance from the copyright holder before you make use of the digital image.  It is your responsibility as the person wishing to use the image to obtain clearance from the copyright holder.  For further information about copyright of images found within Liverpool Plains Photo Gallery, please contact us.
